Re: Re: Business expense?

just a follow up to the original poster's question...

yes, you can practice medicine to a certain extent before taking the USMLE exam... my brother is currently doing a residency while taking the exam... then again... i'm not sure if doing a residency consitutues practicing medicine or not.

anyone know where to draw the line... and ultimately, is the USMLE tax deductible?

The rules state that you're not allowed to deduct exams and initial licenses that qualify you for a new trade or business. Only those educational and licensing expenses that enhance your skills in your current trade or business can be deducted.

That's why medical school is not deductible. The same holds true for accountants who take the CPA exam and lawyers who take the Bar exam. Since lawyers can't practice law if they haven't passed the bar exam, the fee to take the bar exam isn't tax deductible. However, an attorney licensed in one state is allowed to deduct the cost of another state's bar exam.

So the question is whether you can practice medicine in any capacity without first passing the licensing exam. Are you allowed to work as a physician within a hospital if your haven't yet passed the licensing exam? If so, then the cost of the exam can probably be deducted.
