Re: FICA - Is it worth filing?

It appears the IRS hasn't decided how to deal with this issue, and, have stopped responding to these refund requests in most instances. However, we generally recommend that you send in the paperwork, just in case the IRS decides to refund the FICA taxes withheld from medical residents and fellows. It doesn't take too long to fill in the forms. Plus, the only thing that is certain is, if you don't send in the paperwork, you definitely won't receive a refund of your FICA taxes. And maybe if the IRS keeps receiving these refund requests, they will take the time to figure out a course of action.

With respect to which form to file, it appears that the IRS prefers that you use the Form 843 instead of the 1040X.

Let us know if you or your colleagues hear anything from the IRS on this issue.

I have not filed yet, and am wondering A)is it worth the effort, and, B)which of the two forms mentioned should I file, or does it matter?
