FICA Refunds for Residents

As a current resident who just started this year, how can I claim a refund for my FICA withholding per Minn. v. Apfel when I file my 1040. Would it be easier/smarter to file a 1040 and then file a 1040X later?

Based on the feedback I've gotten from your colleagues, the best chance you have of getting back your FICA taxes is if your hospital tries to get those taxes back for all of their residents.

If your hospital won't be filing an abatement on behalf of you and your colleagues, you'll need to file the paperwork yourself. You do so by filing a 1040X a few months after filing your 1040.
